1. Tuition Enrollment I hereby enroll the aforementioned student in The Emery/Weiner School (“the SCHOOL”) for the academic year 2010/11 and further agree to comply with all policies, regulations and procedures of the SCHOOL. I understand that e-mail is the official form of school correspondence and have either provided a valid e-mail address with this tuition agreement or have separately informed the school in writing that I require notice to my home address. I understand and agree that this Enrollment and Tuition Payment Agreement is a binding and enforceable contract and that I become legally bound to comply with all of its terms and obligations, and acknowledge my understanding of and agreement to all of those terms and obligations, upon checking the “I AGREE” box below prior to submitting payment.
2. Tuition Payment: I understand and accept that, once I select a plan/payment method set forth in paragraph 5 below and check the “I AGREE” box for this Agreement, that plan/payment method cannot be changed without the written consent of the SCHOOL for the remainder of the academic year covered by this Agreement.
3. Full-Year Tuition Obligation – The Only Exceptions: I acknowledge that the SCHOOL relies upon returned enrollment agreements such as this Agreement when making decisions related to the hiring of faculty and staff and other matters for the 2010/11 academic year. I further acknowledge that the tuition obligation created by this Agreement is independent of and not affected by any other student’s decision to enroll at the SCHOOL. I therefore agree that, once I signify my agreement herein to the terms of this Agreement and either electronically or by regular mail return this Agreement to the SCHOOL, and unless I can demonstrate that the SCHOOL has received written notice from me on or before April 20, 2010 that I am terminating this Agreement (proper termination notice to the SCHOOL on or before April 20, 2010 will result in a refund of the required deposit please note convenience fees are non-refundable), I fully understand, acknowledge and agree that I am obligated to pay the FULL tuition amount required by this Agreement for the entire 2010/11 academic year unless the student’s post-April 20, 2010 withdrawal from the SCHOOL results from one of the following three circumstances (in which circumstance only a pro rata tuition refund, dating from the date the student withdraws from the SCHOOL, will be granted by the SCHOOL):
1. the student’s custodial family moves its primary residence more than 50 miles from the SCHOOL and a 30-day prior written notice of the move is given to the SCHOOL, or 2. the student has an extended absence of at least 30 school days due to serious illness, or 3. the student is withdrawn from the SCHOOL at the SCHOOL's request for a reason other than non-compliance with this Agreement or failure to comply with the SCHOOL's policies, regulations, or procedures
Notwithstanding the foregoing, if, after April 20, 2010 but on or before the first day of the 2010-2011 academic year: (1) the SCHOOL received written notice that the custodial family is withdrawing the student from the SCHOOL and (2) the custodial family concurrently agrees in writing to pay 75% of the tuition obligation owed under this Agreement within 60 days thereafter, then the tuition obligation under this agreement shall be reduced by 25%. If these requirements are not strictly complied with, the tuition obligation created under this Agreement shall remain due and owing in full.
In the event of a natural disaster, war, act of God, or similar circumstance not attributable to the SCHOOL which prevents normal SCHOOL operations for a sustained period, and which, in the SCHOOL’s sole judgment, makes it impractical to reasonably achieve the academic objectives for the remainder of the academic year, neither the SCHOOL nor the family will thereafter be bound by this Agreement. In such cases, the SCHOOL will provide written notice if this provision has been triggered.
4. Trips, Activities & Other Fees: The SCHOOL includes most required trips, activities and technology replacement costs into the cost of tuition. Tuition includes Parent Association dues ($35), campus security, retreats, P. E., field trips, Hebrew language programming, community-service activities, clubs, school publications, art, the yearbook, planner, pencil bag, participation in the play, basketball, soccer, track, volleyball, baseball, etc. In addition, the SCHOOL invests over $100,000 annually in technology to maintain a state-of-the-art wireless campus. Only certain individualized activities, such as parking, cheerleading uniforms and camp, football uniforms, and other uniforms students keep as well as the senior trip to Israel, require separate fees. Books and uniforms are purchased separately from vendors who have contracted with the school - MBSDirect.com (books) and Sue Mills (for Middle School uniforms), respectively. Kosher lunches may be purchased directly from Educational Catering.
5. Finance, Administration and Late Charges: Tuition payment plans are as follows: 1. Pay In Full – Check or Electronic Check (Full payment is due by June 1, 2010. Late fees of $15 per day will be added to balances received after June 1. ) 2. Pay In Full – Credit Card (Full payment is due by June 1, 2010. Late fees of $15 per day will be added to balances received after June 1. A convenience fee of 2.5% will be added.) 3. Monthly – Automatic Debit (Convenience fees and/or financing charges of up to 8% will be added. Monthly payments are generally drawn on the 5th of the month.) 4. Monthly – Credit Card (Convenience fees and/or financing charges of up to 8% will be added. monthly payments are generally drawn on the 5th of the month.) 5. Financial Aid – Automatic Debit (Convenience fees and/or financing charges of up to 8% will be added. Monthly payments are generally drawn on the 5th of the month. Rejected ACH, or debit or credit charges shall incur a $35 fee plus applicable bank fees which will be added to tuition balances. Any accounts that are delinquent by more than 30 days will incur an additional $50 late fee.
6. Delinquent Accounts: I acknowledge that timely payment of tuition and other SCHOOL fees in accordance with this Agreement is essential to the operating budget of the SCHOOL. I therefore agree that, should any amounts owed by me (whether for tuition, fees or any other school charges) be delinquent by 30 or more days, then, unless all past due balances are fully paid no later 10 days after the SCHOOL sends written notice of such delinquency to the physical or email address of the Financially Responsible person named in this transaction. I hereby grant the SCHOOL, at its sole discretion, the right and authority, at any time while any such delinquency exists, to: 1. withhold school records and transcripts; and/or 2. suspend the student identified above.
7. Financial Aid: If you would like to apply for financial assistance, contact Rosiland Ivie at 832-204-5904 or email rivie@emeryweiner.org. Please apply as early as possible as the majority of the allocations are made in late March. If you apply for financial assistance and for any reason the SCHOOL is not able to offer financial aid in the amount which you wish to accept, you will be entitled to a full refund of your deposit upon written notice and request to the SCHOOL. Initial testing and application fees are not refundable. 8. Right to Dismiss and Right to Decline to Re-Enroll: At any time during the academic year, the SCHOOL reserves the right to dismiss, or to decline to re-enroll, any student who, in the SCHOOL’s sole discretion, in effort, progress, or conduct is not fulfilling the SCHOOL’s expectations, whether such conduct is on campus or occurs outside of school-sponsored activities. Similarly, the SCHOOL reserves the right to dismiss or to decline to re-enroll any student whose re-enrollment, in the sole discretion of the SCHOOL, is deemed by the SCHOOL not to be in the best interest of the SCHOOL or whose parents are deemed by SCHOOL officials not to support the SCHOOL’s mission, philosophy, expectations and rules. This Agreement creates no expectancy of re-enrollment for any future academic years.
9. Services Rendered: The SCHOOL will endeavor to provide the student with instruction, guidance, and encouragement as described in the published statement of mission, philosophy, expectations and rules.
10. Photo Release and Consent: For purposes of communication (primarily within the Emery/Weiner community of students, parents, alumni, and friends via brochures, the SCHOOL website and “Kotarot”), advertising and media, the SCHOOL frequently invites students to be photographed, quoted, and/or interviewed. In addition, students occasionally are asked to contribute their writing, art and/or quotes to SCHOOL publications. By checking “I AGREE” below (and unless or until I withdraw this consent by means of a separate written notice to the SCHOOL), I hereby grant the SCHOOL permission for my child’s photograph, video, quotes, stories or art to be used in ways that enhance the profile of the SCHOOL.
11. Binding Effect of this Agreement: I hereby acknowledge that I have carefully read and understood this entire Agreement and, by selecting the “I AGREE” box below, hereby acknowledge my understanding of and agreement to abide by all the provisions of this Agreement.
